The 10th Amendment - a letter to the Va. Attorney General

Dear Mr. Cuccinelli,

Thank you for your continued efforts in protecting the citizens of Virginia from federally enacted albeit unconstitutional legislation. In specific focus the Patient Protection and Affordable Care Act (ObamaCare) where you have led Virginia to file suit against the implementation of such law. We follow the updates shared and fully support this effort.

As we witness an ever-growing trend of unconstitutional laws enacted by the federal government we turn more to the premise of the tenth amendment. Over the last century the power of the federal government has gradually though steadily usurped the individual states power. As this has been a step by step process we perhaps did not notice each step though are able to clearly see the consolidation of each into a ever-burgeoning dominate federal government.

This is not going unnoticed nor ignored by many states. Texas, Maine , Montana , Oregon , and Wyoming are leading the way with declaring the intent to strike the Healthcare bill “Null & Void.” Last year Virginia itself enacted Real ID nullification legislation and is currently debating the same in the Firearms Freedom Act.
Nullification legislation should not be considered as a lunatic initiative by extremists. Thomas Jefferson, one of our own founding fathers was quite explicit in saying that any time the federal government assumes undelegated powers the states have the right to nullify such. Being that approximately thirty powers were delegated to the federal government in the constitution by the states we are in need of utilizing this tool more often.

with best regards,

Jonathan E. Varnell
